These Terms and Conditions (the “Terms”) govern your access to and use of the RentalCheckPro website, any related applications or portals, and the screening support, document intake, review facilitation, and reporting services made available by RentalCheckPro (together, the “Services”). In these Terms, “RentalCheckPro”, “Company”, “we”, “us”, and “our” refer to RentalCheckPro, and “Applicant”, “you”, and “your” refer to the individual using the Services. You must read these Terms carefully before creating an account, starting a screening procedure, submitting any information or documents, making any payment, generating any screening output, or sharing any report with a third party. By clicking to accept, creating an account, making a payment, using the Services, uploading documentation, initiating a screening procedure, or otherwise interacting with the Services, you confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Services. If you use the Services on behalf of another person or organisation, you represent and warrant that you are duly authorised to bind that person or organisation; however, unless expressly stated otherwise, the Services are intended primarily for natural persons acting in a personal capacity. 1. Definitions 1.1 In these Terms, unless the context requires otherwise, the following capitalised terms shall have the meanings set out below. “Account” means the registered user account created by an Applicant in order to access or use the Services, initiate a screening procedure, upload documents, manage information, or receive outputs. “Applicant” means a natural person who registers for, accesses, or uses the Services, including any person who submits, attempts to submit, or authorises the submission of information or documentation through the platform. “Applicant Support” means the Company’s applicant-facing service function, including support relating to account access, technical matters, billing questions, complaint intake, and general platform assistance. “Screening Procedure” means the process through which an Applicant provides personal, identity-related, financial, and supporting documentation for the purpose of screening facilitation, document handling, consistency review, verification workflows, and report generation. “Screening Report” means any report, summary, output, file, presentation, result, or structured screening-related document generated by the Company on the basis of information and documents submitted by the Applicant, including any indicators, flags, summaries, formatting, or internal consistency observations. A Screening Report reflects information at a particular time and does not constitute a certification, legal ruling, licence, or binding validation. “Provider” means any third party that may request, receive, assess, consider, or rely upon a Screening Report or related information, including without limitation landlords, letting agents, employers, lenders, brokers, marketplaces, property-related intermediaries, institutions, or other screening requesters. “Services” means the website, portal, account functions, document upload environment, screening workflows, optional verification features, support services, report generation services, subscriptions if offered, and any related or future functions made available by the Company. “Website” means the RentalCheckPro website, including all subdomains, related online interfaces, mobile-compatible versions, and any application or portal through which the Services are provided. “Terms” means these Terms and Conditions, together with all policies incorporated by reference, including the Privacy Policy and any feature-specific, purchase-specific, or workflow-specific terms presented to you during use of the Services. 2. Scope, Contract Formation, and Amendments 2.1 These Terms apply to all Applicants who access the Website, create an Account, begin or attempt to begin a Screening Procedure, submit documentation, make payment, generate or receive a Screening Report, or otherwise make use of any part of the Services. 2.2 By accepting these Terms electronically or by using the Services in any manner that indicates assent, you enter into a legally binding agreement with the Company. You agree that electronic acceptance, including tick-box confirmations, digital acknowledgements, in-platform acceptance mechanisms, and comparable forms of assent, shall constitute valid and enforceable acceptance to the fullest extent permitted by applicable law. 2.3 The Company may amend, supplement, or replace these Terms from time to time for legitimate business, operational, legal, regulatory, security, anti-abuse, technical, or commercial reasons. Where a change materially affects your rights or obligations, we will make reasonable efforts to notify you, for example through the Website, the Account environment, or by email. 2.4 Your continued use of the Services after updated Terms become effective shall constitute your acceptance of those updated Terms. If you do not agree to the updated Terms, you must cease using the Services and, where applicable, close your Account, subject always to any obligations that accrued before termination and any non-refundable sums already due or paid. 2.5 You remain solely responsible for reviewing the most current version of these Terms and any policies or notices incorporated into them. Subject to mandatory law, failure to read revised Terms shall not affect their validity or enforceability. 3. Nature of the Services and Important Limitations 3.1 RentalCheckPro provides a screening facilitation and reporting service designed to enable Applicants to submit structured personal, identification, financial, and supporting information for review, processing, handling, and presentation in the form of a Screening Report. The Services may include workflow automation, document review stages, formatting tools, consistency indicators, optional verification procedures, fraud-control steps, or related process-support functions. 3.2 The Services are administrative and procedural in nature. They do not amount to certification, approval, legal verification, legal advice, financial advice, regulated due diligence, underwriting, tenancy approval, employment approval, lending approval, or any guarantee that an Applicant will be accepted by a Provider. 3.3 The Company is not the Provider, does not replace the Provider, and does not make final rental, tenancy, employment, lending, underwriting, contractual, or eligibility decisions. Any such decision is made solely by the relevant Provider or third party, applying its own criteria, policies, risk appetite, procedures, internal standards, and timelines. 3.4 You acknowledge and agree that the Company has no control over whether a Provider accepts, rejects, delays, questions, disregards, or applies additional scrutiny to any Screening Report. The Company shall therefore not be responsible for any Provider decision, non-decision, refusal, delay, policy requirement, compliance framework, or other action or omission of any Provider or third party. 3.5 Any Screening Report is generated solely on the basis of information, declarations, and documentation submitted by or on behalf of the Applicant. While the Company may carry out reasonableness checks, consistency checks, formatting processes, or use third-party support tools, the Company does not guarantee that submitted information is true, complete, current, authentic, accepted by a third party, or legally sufficient for any purpose. 3.6 No part of the Services constitutes legal, financial, tax, investment, professional, regulatory, or compliance advice. You remain solely responsible for seeking independent professional advice wherever appropriate. 4. Eligibility, Registration, and Applicant Assurances 4.1 You may use the Services only if you are at least 18 years old and have full legal capacity under the laws applicable where you reside or use the Services. 4.2 The Company may at any time request proof of age, identity, residence, authority, or other supporting evidence where reasonably necessary for fraud prevention, compliance, security, or platform integrity purposes. 4.3 Unless expressly permitted otherwise by the Company, you may maintain only one Account. The Company may suspend, restrict, merge, refuse, or terminate duplicate or suspicious Accounts in order to prevent misuse, manipulation, evasion, fraud, or operational abuse. 4.4 You represent, warrant, and undertake that all information provided by you at registration and throughout any Screening Procedure is accurate, complete, current, lawful, truthful, and not misleading. You further represent that you are legally entitled to submit all documents, information, and data uploaded or provided through the Services. 4.5 Where the Company reasonably suspects false information, misleading information, document alteration, identity manipulation, payment abuse, unlawful conduct, sanctions exposure, fraud risk, or any material breach of these Terms, the Company may refuse registration, suspend access, request additional verification, delay the Screening Procedure, close the file, or terminate the Account. 4.6 You are responsible for keeping your Account data and contact information up to date. The Company shall not be responsible for consequences arising from outdated, incomplete, or incorrect Account information provided by you. 5. Fees, Payment Basis, Non-Refundability, and Optional Services 5.1 Unless expressly stated otherwise, use of the Services requires payment of a one-time screening fee, service fee, processing fee, or such other fee as may be indicated at the time of purchase or initiation of the Screening Procedure. 5.2 You acknowledge that the Company incurs costs immediately upon initiation of the Screening Procedure, including without limitation administrative allocation, infrastructure costs, fraud prevention measures, support resources, workflow preparation, compliance procedures, processing capacity, technical systems, and third-party transaction costs. 5.3 Accordingly, and to the fullest extent permitted by applicable law, the relevant fee shall be deemed earned upon commencement of the Screening Procedure or other relevant service step. 5.4 All payments made for the Services are final and non-refundable, except where mandatory applicable law requires otherwise. This applies irrespective of whether: (a) you complete the Screening Procedure; (b) you fail to upload all required documents; (c) your submission is inconsistent or incomplete; (d) no Screening Report is generated; (e) a Provider rejects the Screening Report; (f) the outcome is different from your expectations; or (g) you decide not to continue after payment. 5.5 The Services may from time to time include or refer to optional modules, supplementary functions, premium features, or future add-ons. Any such feature shall only be included where expressly stated by the Company and shall not be deemed part of the standard service unless confirmed in writing or displayed as included at the relevant time. 5.6 Unless otherwise stated in the service flow, you must provide all required information and documentation within seven calendar days from the date the Screening Procedure is initiated. If you fail to do so, the Company may pause, cancel, archive, or close the Screening Procedure without issuing any refund, subject to mandatory law. 6. Applicant Responsibilities During the Screening Procedure 6.1 You are solely responsible for ensuring that all documents uploaded or submitted are genuine, valid, complete, legible, current where required, and unaltered, and that all information entered into the platform accurately corresponds with those documents. 6.2 The Company may reject, flag, suspend, or refuse to process any document or submission that appears blurred, incomplete, contradictory, expired, manipulated, suspicious, misleading, or otherwise unsuitable for processing. 6.3 The Company may use manual checks, automated checks, third-party service providers, verification tools, or internal review processes to assess consistency, technical suitability, and process compliance. 6.4 If discrepancies, omissions, mismatches, or unusual indicators arise, including in relation to identity, date of birth, address history, document validity, income information, or other submitted data, the Company may request clarification or additional documents, suspend the Screening Procedure, or close it altogether in its discretion. 6.5 You may not submit information, documents, or personal data belonging to a third party unless you have lawful authority to do so. You are solely responsible for obtaining all permissions, authorisations, notices, or consents required by law in relation to any third-party information submitted by you. 7. Screening Reports, Validity, and Reliance 7.1 Unless expressly stated otherwise, Screening Reports are generally intended to reflect a snapshot of the information available at the time of issue and may become outdated after issuance. 7.2 A Screening Report may, unless stated otherwise, be treated as current for up to 30 days from the date of issue; however, the Company makes no representation that any Provider will accept such period as sufficient, and any Provider may request updated information at any time. 7.3 The Company does not warrant, guarantee, or represent that any Screening Report will be accepted by any Provider, will satisfy any Provider’s requirements, or will result in any approval, offer, tenancy, employment relationship, financing arrangement, or other desired outcome. 7.4 Any flags, scores, indicators, summaries, or consistency notes contained in a Screening Report are informational only and do not constitute a legal conclusion, legal status, certification, or binding factual determination. 8. Account Security and Use of Credentials 8.1 You are responsible for maintaining the confidentiality and security of your login credentials, authentication methods, devices, and associated communication channels. 8.2 You are responsible for all activity carried out through your Account, whether or not such activity was specifically authorised by you, except to the extent that mandatory law provides otherwise. 8.3 If you suspect unauthorised access, misuse, compromise, or loss of control of your Account, you must notify the Company without undue delay. The Company may suspend or restrict access pending review. 8.4 To the fullest extent permitted by law, the Company shall not be liable for any loss or damage arising from weak passwords, shared credentials, compromised devices, intercepted communications, or your failure to take reasonable account-security measures. 9. Suspension, Closure, and Termination 9.1 These Terms remain in force from the moment you accept them or first use the Services until terminated in accordance with this section. 9.2 You may request closure of your Account by contacting Applicant Support. Closure of the Account ends your right to access the Services, but does not affect accrued liabilities, payment obligations, data retention rights, or any section intended to survive termination. 9.3 The Company may suspend, restrict, or terminate your Account or access to the Services immediately where it reasonably believes that you have breached these Terms, engaged in fraud, misused the Services, caused legal or compliance risk, initiated abusive disputes, or otherwise created material risk for the platform, Providers, or third parties. 9.4 The Company may also suspend, archive, or delete inactive Accounts after a prolonged period of inactivity, subject to reasonable notice where feasible and subject always to any retention obligations or legitimate business needs. 9.5 Termination or suspension does not affect provisions relating to fees, non-refundability, disclaimers, limitations of liability, indemnities, payment disputes, dispute resolution, governing law, intellectual property, or any other provision which by its nature is intended to continue after termination. 10. Chargebacks, Payment Disputes, and Recovery of Costs 10.1 You agree not to initiate, support, or encourage any chargeback, payment reversal, payment dispute, refund request, or comparable claim other than in good faith where you genuinely and reasonably believe that the charge was unauthorised or made in error. 10.2 You acknowledge that chargebacks and payment disputes may cause the Company direct losses, administrative costs, reputational harm, payment-provider penalties, operational burden, and increased risk exposure. 10.3 If you initiate or support a payment dispute, the Company may suspend your Account, halt ongoing processing, refuse future service, and take such reasonable steps as are necessary to protect its commercial position. 10.4 To the fullest extent permitted by applicable law, where the Company incurs chargeback fees, administrative costs, payment-provider penalties, legal expenses, recovery costs, or related losses arising from a dispute initiated by you in breach of these Terms, the Company may seek to recover those amounts from you. 10.5 Where lawful and proportionate, and without prejudice to the Company’s right to prove higher actual loss where permitted, the Company may claim a fixed amount of up to EUR 1,500 in European countries, GBP 1,500 in the United Kingdom, and USD 1,500 in the United States and other regions, as a reasonable estimate of administrative and reputational harm arising from abusive or unjustified payment disputes. 11. Intellectual Property and Permitted Use 11.1 All intellectual property rights in and to the Website, Services, software, databases, workflows, designs, reports, report structures, trade marks, logos, text, graphics, layouts, screening logic, systems, and underlying materials belong to the Company or its licensors. 11.2 Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services solely for your own lawful personal screening-related purposes. 11.3 You must not copy, reproduce, distribute, modify, reverse engineer, scrape, crawl, harvest, republish, exploit, extract, or attempt to derive the source code, report structures, scoring methods, screening logic, algorithms, or platform mechanics of the Services, except to the limited extent that applicable mandatory law expressly permits such activity. 12. Privacy, Data Handling, and Personal Information 12.1 The Company processes personal data for the purpose of operating and providing the Services. Further details of our data practices are set out in the Privacy Policy, which is incorporated into these Terms by reference. 12.2 You acknowledge that use of the Services may involve the submission of personal data, identity data, financial data, and supporting documents which may be sensitive in nature. You remain solely responsible for ensuring that you are lawfully entitled to provide all information and documentation submitted by you. 12.3 To support international consistency, the Company may apply Swiss-law principles in relation to privacy frameworks, internal policies, platform governance, and related procedural matters, without prejudice to any mandatory local rights that may apply. 13. Disclaimers and Third-Party Dependencies 13.1 To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. The Company makes no representation, warranty, or guarantee, whether express, implied, statutory, or otherwise, regarding uninterrupted availability, merchantability, fitness for a particular purpose, suitability for a Provider’s requirements, non-infringement, accuracy, completeness, or reliability. 13.2 The Company may depend on third-party service providers for hosting, communications, payment processing, verification tools, storage, security, and related infrastructure. The Company shall not be responsible for outages, interruptions, failures, delays, inaccuracies, or other issues caused by third-party providers or events outside its reasonable control. 14. Limitation of Liability and Specific Acknowledgements 14.1 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential loss or damage, including without limitation loss of profit, income, business, reputation, goodwill, opportunity, or data. 14.2 To the fullest extent permitted by law, the Company shall not be liable for: (a) Provider decisions or refusals; (b) Provider misuse or interpretation of a Screening Report; (c) delays or failures caused by third parties; (d) inaccuracies in Applicant-submitted information; (e) interruptions beyond the Company’s reasonable control; (f) failure to generate a report because of inconsistency, incompleteness, non-cooperation, or non-compliance by the Applicant; or (g) any action taken by a third party in reliance on the Screening Report or related information. 14.3 To the fullest extent permitted by law, the total aggregate liability of the Company arising out of or in connection with the Services or these Terms shall not exceed the greater of EUR 20 or the amount actually paid by you for the specific Screening Procedure giving rise to the claim. 14.4 Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by mandatory law. 14.5 For the avoidance of doubt, any screening ID, file reference, or status identifier issued to you does not itself grant access to the Screening Report or to the personal data contained in it. Such identifier operates solely as a reference and status-tracking mechanism. 14.6 Once a Screening Report has been issued, you are solely responsible for its management, retention, handling, use, and onward sharing, unless the Company expressly agrees otherwise. The Company will not disclose your Screening Report to a third party unless you have granted explicit prior authorisation or unless disclosure is otherwise required or permitted by law. 14.7 You are responsible for keeping a copy of your Screening Report for your own records and, where relevant, for transmitting it directly to the appropriate Provider. 14.8 By proceeding, you confirm that you have read, understood, and accepted these Terms, the Terms of Service where separately presented, and the Privacy Policy, and that you accept full responsibility for the use, handling, and sharing of your Screening Report. 14.9 You expressly confirm that all information submitted by you is true, accurate, complete, and not misleading, and you accept full responsibility for any consequences arising from inaccurate, incomplete, false, or misleading submissions. 14.10 The Company is not a legal, financial, professional, regulatory, or advisory body. No content, report, communication, or output provided by the Company shall be interpreted as legal advice, financial advice, regulated advice, certified validation, or any legally binding determination. 15. Indemnity 15.1 You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, affiliates, contractors, licensors, service providers, and agents from and against all claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable legal fees, arising from or related to: (a) your breach of these Terms; (b) false, unlawful, misleading, or infringing information or documents submitted by you; (c) your misuse of the Services; (d) any claim by a Provider or third party arising from your conduct or your Screening Report; (e) payment disputes, chargebacks, or complaints initiated by you; (f) your breach of law or third-party rights; or (g) your unauthorised submission of third-party data or materials. 15.2 This indemnity shall survive suspension, closure, or termination of your Account and of these Terms. 16. Complaints, Support, and Communications 16.1 Applicant Support may be contacted through the contact channels made available on the Website or within the Services. 16.2 The Company may decline to process abusive, repetitive, vexatious, threatening, bad-faith, or manifestly unfounded complaints, subject always to applicable mandatory law. 16.3 Where the Company refuses to handle a complaint, it will aim to communicate that position within a commercially reasonable period. 16.4 By using the Services, you consent to receive communications from the Company electronically, including service notices, legal updates, billing-related messages, account notices, and operational information. 17. Governing Law, Jurisdiction, and Dispute Procedure 17.1 Unless mandatory consumer law requires otherwise, these Terms and any non-contractual obligations arising out of or in connection with them shall be governed by the substantive laws of Switzerland. 17.2 For Applicants residing outside the United States, and to the fullest extent permitted by law, the courts of the Canton of Geneva, Switzerland, shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Services. 17.3 Before commencing formal proceedings, each party shall, where legally permissible, first attempt in good faith to resolve the dispute informally by written notice and a cure period of 30 days. 17.4 Any claim, complaint, or dispute initiated by the Applicant in connection with the Services or these Terms must be submitted and administered exclusively through the World Intellectual Property Organization (“WIPO”), in accordance with the applicable rules, procedures, and guidelines in force at the time of filing, to the extent permitted by applicable law. 17.5 The Applicant agrees that all costs associated with any such WIPO-based claim, complaint, or proceeding, including filing fees, administrative fees, procedural costs, legal costs, and related expenses, shall be borne solely by the Applicant on both a pre-paid and post-paid basis, to the extent permitted by law. 17.6 For the purpose of ensuring consistency, neutrality, and enforceability on an international basis, the Company applies Swiss-law principles in relation to privacy matters, data handling frameworks, internal policies, contractual interpretation, and the handling of formal proceedings following any determination that a claim has been validly accepted within the WIPO process. 17.7 If a claim, complaint, or dispute brought by the Applicant is found, in whole or in part, to be invalid, inadmissible, unsubstantiated, or unfounded, the Applicant shall remain fully liable, to the extent permitted by applicable law, for all resulting costs. Such costs include the Applicant’s own legal and procedural expenses, all sums payable to WIPO, and all reasonable legal, administrative, and related costs incurred by the Company. 17.8 Any amount payable by the Applicant to the Company under this section shall be payable via a payment method designated by the Company and shall be additional to, and not a substitute for, any fixed administrative fee or other sum payable elsewhere under these Terms or any other legally binding document governing the Services. 17.9 By continuing, the Applicant confirms that they have read, understood, and agreed to the entirety of this legally binding document. 18. Miscellaneous 18.1 Entire Agreement These Terms, together with all policies and documents incorporated by reference, constitute the entire agreement between you and the Company in relation to the Services and supersede all prior discussions, representations, communications, and understandings relating to the same subject matter. 18.2 Severability If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable where possible, and the remaining provisions shall remain in full force and effect. 18.3 Assignment The Company may assign, transfer, subcontract, or novate its rights and obligations under these Terms without your consent. You may not assign, transfer, charge, hold on trust, or otherwise dispose of your rights or obligations under these Terms without the Company’s prior written consent. 18.4 No Waiver Any failure or delay by the Company in exercising any right or remedy under these Terms shall not operate as a waiver of that or any other right or remedy. 18.5 Headings Section headings are included for convenience only and shall not affect the interpretation of these Terms. 18.6 Survival Any provision which by its nature is intended to survive expiry or termination of these Terms shall survive, including without limitation provisions relating to fees, payment disputes, non-refundability, limitation of liability, indemnities, intellectual property, dispute resolution, and governing law.

These Premium Terms supplement, and are incorporated into, the general Terms and Conditions, Terms of Service, Conditions of Use, Privacy Policy, payment terms, workflow disclosures, checkout disclosures, and any feature-specific notices displayed by RentalCheckPro. In the event of any inconsistency, these Premium Terms shall apply specifically to Premium Services except to the extent mandatory law requires otherwise. By selecting, activating, purchasing, subscribing to, continuing with, or otherwise using any Premium Service, the Applicant confirms that they have read, understood, and agreed to be legally bound by these Premium Terms in full. If the Applicant does not agree to these Premium Terms, the Applicant must not purchase, activate, access, continue using, or otherwise rely upon any Premium Service. 1. References to words such as “including”, “includes”, and “such as” shall be construed as meaning “including without limitation”. “Account” means the personal RentalCheckPro account created by an Applicant on the Website or through any affiliated interface for the purpose of accessing and using the Services, including any standard or Premium Service features. “Applicant” means the natural person who registers for an Account, purchases or activates any Service, submits or attempts to submit information or documentation, or otherwise uses the Website or Services. “Applicant Service” means the applicant-facing service environment made available by RentalCheckPro, including onboarding, screening workflows, data intake, document upload modules, declarations, questionnaires, optional verification steps, Premium Service modules, and the generation, display, or transmission of screening outputs. “Company”, “RentalCheckPro”, “we”, “us”, and “our” mean RentalCheckPro, together with its affiliates, parent entities, subsidiaries, successors, assigns, officers, directors, employees, agents, contractors, licensors, service providers, payment processors, technical partners, and authorised representatives where the context permits. “Enhanced Screening Services” or “Premium Services” mean any optional, additional, upgraded, premium, subscription-based, recurring, enhanced, or promotional screening-related service, module, feature, workflow, or package offered by the Company that exceeds, supplements, or differs from the standard screening service. “Payment Method” means any debit card, credit card, bank account, direct debit mandate, digital wallet, PayPal account, stored credential, or other payment instrument accepted by the Company or its payment processor. “Provider” or “Requesting Provider” means any landlord, letting agent, employer, lender, institution, platform, broker, intermediary, service provider, marketplace, counterparty, or other third party that may request, receive, review, consider, or rely on a screening output or related information. “Screening Process” means the workflow through which the Applicant submits information, uploads documentation, completes prompts, answers questionnaires, selects service options, undertakes verification steps, and participates in the generation of screening outputs. “Screening Report” or “Screening Output” means any report, output, file, structured summary, result, status, or screening-related presentation generated by the Company on the basis of Applicant-submitted information and any applicable technical or verification steps. “Services” means the Website, the Applicant Service, standard screening services, Premium Services, subscriptions, optional features, support functions, verification modules, and any related tools, products, or digital offerings provided by RentalCheckPro. “Subscription” means any recurring, renewing, time-based, premium, trial, promotional, or ongoing paid service arrangement under which the Applicant is charged periodically unless cancelled in accordance with these Premium Terms and applicable payment processor rules. “Terms” means these Premium Terms together with all general Terms and Conditions, Terms of Service, Conditions of Use, Privacy Policy, checkout disclosures, workflow disclosures, and any related legal documents incorporated by reference. “Website” means www.rentalcheckpro.com and any successor URL, subdomain, mobile version, mobile application, embedded interface, webview, or other digital environment through which the Services are made available. 2. ACCEPTANCE; INCORPORATION; LEGAL EFFECT 2.1 These Premium Terms apply whenever the Applicant selects, activates, purchases, subscribes to, continues with, or uses any Enhanced Screening Service or Premium Service. 2.2 The Applicant acknowledges and agrees that electronic acceptance, including clicking a checkbox, pressing a confirmation button, submitting payment details, continuing in the workflow, or otherwise using a Premium Service, constitutes valid and binding legal acceptance. 2.3 By proceeding, the Applicant confirms that they have carefully reviewed all disclosures presented at checkout, within the workflow, or on the relevant service screen, including the nature of the Premium Service, the applicable Fees, the non-refundable character of charges, any recurring billing features, and any cancellation instructions. 2.4 The Applicant further acknowledges that all notices, disclosures, pricing details, duration descriptions, service limitations, and linked legal documents shown on the Website or within any associated workflow form part of the contractual framework between the Applicant and the Company. 2.5 If the Applicant does not agree with any part of these Premium Terms, the Applicant must not proceed with the relevant Premium Service. 3. NATURE OF PREMIUM SERVICES 3.1 Premium Services are optional services offered by the Company in addition to, or as an enhancement of, the standard screening service. Such services may include, without limitation, enhanced screening layers, extended report availability, subscription-based access, premium workflow access, recurring status services, additional verification modules, premium support features, expedited processing elements, or promotional service packages. 3.2 The Company may, in its sole discretion, determine which Premium Services are available, to whom they are offered, on what terms they are offered, and whether such services are made available by default, by invitation, through checkout selection, as part of a promotion, or upon request. 3.3 The Applicant acknowledges that Premium Services may vary by jurisdiction, platform, Provider type, technical availability, operational requirements, promotional period, or compliance framework. 3.4 Reference to Premium Services on the Website or in the workflow does not obligate the Company to make such services permanently available, nor does it create any entitlement to future upgrades, expanded functionality, or continued availability. 4. APPLICANT REPRESENTATIONS AND WARRANTIES 4.1 By using any Premium Service, the Applicant represents, warrants, and undertakes on a continuing basis that: (a) the Applicant is at least 18 years old and has reached the age of majority in the jurisdiction where they reside or use the Services; (b) the Applicant has full legal capacity and authority to enter into binding agreements; (c) all information, data, declarations, and documents submitted are true, accurate, complete, current, and not misleading; (d) the Applicant is lawfully entitled to submit all information and documentation provided through the Services; (e) any Payment Method used is valid, lawful, and authorised for use by the Applicant; (f) the Applicant is not using the Services from a jurisdiction where such use would be unlawful or would expose the Company to undue legal or regulatory risk; and (g) the Applicant is not acting in breach of any applicable law, third-party right, court order, or contractual obligation. 4.2 The Applicant further acknowledges that inaccurate, incomplete, false, forged, manipulated, outdated, or misleading information may result in suspension, rejection, delay, request for further verification, closure of the Screening Process, refusal to generate a Screening Report, termination of access, or legal and contractual consequences. 4.3 The Applicant accepts sole responsibility for all consequences arising from the submission of inaccurate, false, incomplete, unlawful, or misleading information or materials. 5. NO PROFESSIONAL ADVICE; NO CERTIFICATION; NO GUARANTEED OUTCOME 5.1 The Company does not act as a financial adviser, legal adviser, accountant, tax adviser, compliance consultant, or other professional adviser. Nothing in the Website, Services, Screening Report, or Premium Service shall be interpreted as legal, financial, professional, or regulated advice. 5.2 The Company does not provide legally binding, certified, validated, or official determinations. Screening outputs are generated solely on the basis of Applicant-submitted information, system workflows, available verification signals, and the Company’s internal operational processes. 5.3 The Company is not a decision-maker and does not approve, reject, certify, endorse, or guarantee any Applicant. All final decisions remain exclusively with the relevant Provider or third party. 5.4 The Applicant expressly acknowledges that the Company does not guarantee that any Screening Report or Premium Service output will: (a) be accepted by a Provider; (b) satisfy a Provider’s internal requirements; (c) produce a favourable result; (d) be sufficient for any legal, rental, employment, lending, or institutional purpose; or (e) result in any commercial, contractual, tenancy, employment, or other desired outcome. 6. PAYMENT TERMS FOR PREMIUM SERVICES 6.1 Payment Requirement Access to Premium Services may require payment of a one-time fee, recurring subscription fee, verification amount, promotional trial amount, premium processing amount, or other charge disclosed at checkout or within the relevant workflow. 6.2 Earned Upon Initiation To the fullest extent permitted by applicable law, all Premium Service Fees are deemed earned upon initiation of the relevant Premium Service, activation of the selected service option, start of the subscription term, or commencement of the corresponding processing or verification step. 6.3 Non-Refundable Nature Except where mandatory law expressly requires otherwise, all Premium Service payments are final and strictly non-refundable. This applies irrespective of: (a) whether the Applicant completes the Screening Process; (b) whether a Screening Report is generated; (c) whether the Applicant later discontinues use; (d) whether the outcome is unfavourable or inconclusive; (e) whether a Provider rejects or declines to rely on the output; (f) whether the Applicant no longer wishes to continue; or (g) whether the Applicant considers the service less useful than expected. 6.4 Consideration for Services The Applicant acknowledges that Premium Service Fees are charged in consideration for the allocation of technical capacity, screening infrastructure, verification workflows, support resources, administrative handling, processor integration, fraud controls, compliance steps, and related operational activity. 6.5 Verification Amounts Where a Premium Service includes a nominal verification transaction, such as EUR 0.01, USD 0.01, or local equivalent, the Applicant acknowledges that such amount may be used as a technical verification tool, Payment Method validation mechanism, bank-account confirmation step, eligibility signal, or processor-routing event. 6.6 Checkout Controls The pricing, duration, scope, renewal terms, and key payment conditions disclosed on the relevant checkout page, purchase page, workflow screen, or offer screen shall govern the specific Premium Service purchased, together with these Premium Terms. 7. SUBSCRIPTIONS, AUTOMATIC RENEWAL, AND BILLING 7.1 Where a Premium Service is offered on a subscription or recurring basis, the Subscription shall renew automatically for successive periods unless cancelled before the end of the then-current term, except where mandatory law requires otherwise. 7.2 The Applicant authorises the Company and/or its payment processor to charge the Applicant’s Payment Method automatically for all recurring Subscription Fees, taxes, processor charges, and related amounts due for each renewal term. 7.3 Renewal charges shall be applied at the rate in effect at the time of renewal unless a different rate was expressly agreed or mandatory law requires additional consent or prior notice. 7.4 The Applicant is solely responsible for maintaining a valid Payment Method, monitoring renewal dates, and cancelling the Subscription in a timely manner if the Applicant no longer wishes the Subscription to continue. 7.5 If a valid Payment Method cannot be charged, the Company may suspend, restrict, terminate, downgrade, or withhold the Premium Service without liability and without prejudice to its right to recover unpaid sums. 7.6 Any trial, discounted introductory period, one-cent trial, nominal verification period, or promotional Subscription shall convert into a paid recurring Subscription unless cancelled before the end of the applicable trial or promotional period, where such conversion has been disclosed at checkout or within the relevant offer. 8. CANCELLATION OF PREMIUM SERVICES 8.1 The Applicant may cancel a Premium Subscription only by using the cancellation method authorised by the Company, the payment processor, or the applicable account functionality. 8.2 Unless stated otherwise at checkout or required by mandatory law, cancellation stops future renewal billing only and does not entitle the Applicant to any refund for the current billing period or any previously charged term. 8.3 Where account verification is reasonably required to protect against unauthorised cancellation requests, the Company may require identity or account verification before processing a cancellation request. 8.4 The Applicant remains responsible for any charges incurred before cancellation takes effect. 8.5 Failure to cancel through the correct channel, within the required timeframe, or in accordance with the payment processor’s rules shall not invalidate renewal charges that were properly incurred. 9. BILLING DISPUTES, CHARGEBACKS, AND ENFORCEMENT COSTS 9.1 If the Applicant believes that a payment has been charged in error, the Applicant must first submit a good-faith written billing dispute to the Company through the designated support channel and provide adequate supporting details. 9.2 Unless mandatory law requires otherwise, the Applicant must raise any billing dispute within thirty (30) days after the disputed charge first appears. Failure to do so may result in waiver of the dispute to the fullest extent permitted by law. 9.3 The Applicant agrees not to initiate or support any Chargeback, reversal, refund request, payment dispute, or retrieval action in respect of a valid charge except in good faith where the Applicant genuinely believes the payment was unauthorised or processed in error. 9.4 If the Applicant initiates a Chargeback or payment reversal contrary to these Premium Terms, the Company may suspend the Account, suspend active services, refuse future service, and pursue recovery of all reversed amounts, processor fees, administrative handling costs, collection charges, and legal expenses to the fullest extent permitted by law. 9.5 Where permitted by applicable law, the Company may also seek a fixed administrative fee of up to EUR 750 per demonstrably unfounded complaint, claim, or dispute, and up to EUR 1,500 or such other amount lawfully provided for elsewhere in the contractual framework for abusive or bad-faith Chargeback activity, provided always that any such recovery is pursued lawfully and proportionately. 9.6 The Applicant acknowledges that payment disputes may cause direct and indirect loss to the Company, including processor penalties, operational burden, fraud-risk scoring impacts, reputational damage, and resource diversion. 10. REFUNDS AND DISCRETIONARY CREDITS 10.1 Except where mandatory law expressly requires otherwise, the Company is under no obligation to grant any refund, credit, reimbursement, adjustment, or partial repayment in connection with any Premium Service. 10.2 Any refund, credit, or goodwill adjustment granted by the Company shall be entirely discretionary, may be subject to conditions, shall not constitute an admission of liability, and shall not create any precedent or expectation for future cases. 10.3 Where a specific refund window, trial cancellation right, cooling-off arrangement, pro-rated adjustment, or promotional reimbursement right is expressly offered at checkout for a particular Premium Service, only that specific offer shall apply and only in accordance with the exact conditions disclosed at that time. 10.4 If no such specific refund arrangement is expressly offered at checkout, then no discretionary refund window shall apply beyond any rights required by mandatory law. 11. SCREENING REPORTS, PREMIUM OUTPUTS, AND APPLICANT RESPONSIBILITY 11.1 The Applicant acknowledges that any Screening Report or Premium Service output depends materially on the truthfulness, completeness, legality, and quality of the information and documentation submitted by the Applicant. 11.2 The Company does not guarantee that any Screening Report will be: (a) complete or exhaustive; (b) up to date at all times; (c) free from technical limitations; (d) acceptable to any Provider; or (e) capable of replacing any additional checks required by a Provider. 11.3 The Applicant is solely responsible for reviewing the accuracy of Applicant-submitted information before submission and for ensuring that all uploaded documents are genuine, lawful, legible, unaltered, and properly authorised. 11.4 The Company bears no liability for any Provider rejection, additional Provider requirement, repeated screening request, delay, request for further documentation, or decision to disregard a Screening Report. 11.5 Any Premium Service that extends the availability, visibility, or duration of a Screening Report does not guarantee ongoing Provider acceptance, continuous legal relevance, or perpetual commercial usefulness. 12. ACCOUNT SECURITY AND COMMUNICATIONS 12.1 The Applicant is responsible for maintaining the confidentiality and security of all login credentials, devices, account access data, verification links, and communications associated with the Account. 12.2 Any activity carried out through the Applicant’s Account shall be deemed to have been authorised by the Applicant unless mandatory law provides otherwise. 12.3 The Applicant must notify the Company without undue delay if the Applicant suspects unauthorised access, credential compromise, fraud, or account misuse. 12.4 The Company may send transactional, legal, billing, status, workflow, security, or service-related messages electronically. The Applicant agrees that such communications satisfy any legal requirement that communications be in writing. 12.5 The Applicant is responsible for maintaining a valid email address, monitoring their inbox and spam folders, and retaining copies of important communications where appropriate. 13. COMPANY RIGHTS TO SUSPEND, MODIFY, OR WITHDRAW SERVICES 13.1 The Company may, at any time and to the fullest extent permitted by law, modify, suspend, withdraw, discontinue, limit, replace, reconfigure, or remove any Premium Service, feature, workflow, or part of the Website for legal, technical, commercial, security, compliance, anti-fraud, operational, or business reasons. 13.2 The Company may restrict access to all or part of the Website or Services where reasonably necessary for maintenance, integrity protection, fraud prevention, identity verification, payment verification, legal compliance, system migration, or operational stability. 13.3 The Company shall not be liable merely because any part of the Website or Services is unavailable, delayed, interrupted, restricted, altered, or withdrawn, except where mandatory law requires otherwise. 14. PROHIBITED CONDUCT 14.1 The Applicant must not: (a) submit false, forged, manipulated, misleading, incomplete, or unlawful information or documentation; (b) impersonate another person or use another person’s Account; (c) interfere with the integrity, availability, or security of the Website or Services; (d) introduce malicious code, viruses, automated tools, scripts, bots, or harmful materials; (e) reverse engineer, copy, scrape, extract, harvest, or exploit the Website, screening logic, templates, algorithms, or workflow structure; (f) misuse any Premium Service in a fraudulent, abusive, unlawful, or commercially exploitative manner; or (g) make false, misleading, defamatory, or unsubstantiated public statements attributing an unfavourable third-party outcome to the Company where such attribution is not factually justified. 14.2 Where the Company reasonably determines that the Applicant has engaged in prohibited conduct, the Company may suspend or terminate access, refuse service, invalidate the relevant workflow, report the conduct where lawful, and pursue any rights or remedies available under contract or law. 15. FALSE CLAIMS AND PUBLIC MISREPRESENTATIONS 15.1 The Applicant agrees to refrain from making, publishing, promoting, or repeating any false, misleading, unsubstantiated, defamatory, or materially inaccurate statement regarding the Company, the Services, or any Screening Report. 15.2 This includes, without limitation, public or private statements suggesting that an unfavourable decision made by a Provider was caused by the Company where such assertion is inaccurate, misleading, or unsupported. 15.3 To the fullest extent permitted by applicable law, where the Company reasonably determines that the Applicant has made such false or misleading claims, the Company reserves the right to seek recovery of its reasonable administrative, reputational mitigation, legal, and enforcement costs, including any fixed administrative sum lawfully specified elsewhere in the governing contractual framework. 16. DISCLAIMER OF WARRANTIES 16.1 To the fullest extent permitted by law, the Website and all Services, including all Premium Services, are provided on an “as is”, “as available”, and “with all faults” basis, without any representation, warranty, or guarantee of any kind. 16.2 The Company disclaims all express, implied, statutory, or other warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, uninterrupted availability, security, reliability, or Provider acceptance. 16.3 The Company does not warrant that: (a) the Services will be uninterrupted or error-free; (b) defects will be corrected; (c) the Website will be free of harmful code; (d) any output will meet the Applicant’s expectations; or (e) any Premium Service will achieve any specific commercial or procedural result. 17. LIMITATION OF LIABILITY 17.1 To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, consequential, incidental, special, exemplary, punitive, or reputational losses or damages, including loss of profits, loss of revenue, loss of opportunity, loss of goodwill, loss of business, loss of data, or emotional distress. 17.2 Without limiting the foregoing, the Company shall not be liable for: (a) Provider decisions, refusals, or delays; (b) Applicant-submitted inaccuracies or omissions; (c) third-party processor failures; (d) payment processor issues; (e) internet disruptions; (f) account misuse; (g) regulatory or procedural consequences arising from Applicant conduct; or (h) dissatisfaction with the usefulness, timing, or outcome of any Premium Service. 17.3 To the fullest extent permitted by law, the Company’s total aggregate liability arising out of or in connection with any Premium Service shall not exceed the greater of: (a) EUR 20; or (b) the amount paid by the Applicant for the specific Premium Service giving rise to the claim. 17.4 Nothing in these Premium Terms excludes or limits any liability that cannot lawfully be excluded or limited. 18. INDEMNIFICATION 18.1 The Applicant agrees to indemnify, defend, and hold harmless the Company and its officers, directors, employees, affiliates, agents, contractors, licensors, and service providers from and against any and all claims, losses, liabilities, penalties, damages, costs, expenses, and reasonable legal fees arising out of or related to: (a) the Applicant’s breach of these Premium Terms; (b) false, misleading, unlawful, forged, or infringing submissions; (c) misuse of the Services; (d) violation of law or third-party rights; (e) payment disputes or Chargebacks initiated by the Applicant; (f) public false statements or reputational harm caused by the Applicant; or (g) any Provider or third-party claim arising from Applicant conduct or Applicant-submitted information. 18.2 This indemnity shall survive termination or expiry of these Premium Terms and of the Applicant’s Account. 19. TERMINATION 19.1 The Applicant may stop using the Services at any time, but termination of use does not cancel accrued Fees, recurring charges already properly incurred, or any liabilities that arose before termination. 19.2 The Company may suspend, restrict, disable, or terminate the Applicant’s access to any Premium Service or to the Account where it reasonably believes that the Applicant has breached these Premium Terms, engaged in fraud, misused the Services, created legal or reputational risk, submitted misleading information, or acted contrary to the Company’s legitimate operational or compliance interests. 19.3 Upon termination, the Applicant’s right to access the affected Premium Services shall cease immediately, but all provisions intended to survive termination shall remain in full effect. 20. GOVERNING LAW AND DISPUTE FRAMEWORK 20.1 Unless mandatory law requires otherwise, these Premium Terms and any non-contractual obligations arising out of or in connection with them shall be governed by the substantive laws of Switzerland. 20.2 For purposes of consistency, neutrality, privacy governance, internal policy alignment, and contractual interpretation, the Company applies Swiss-law principles to the operation and enforcement of these Premium Terms, subject always to mandatory local law where applicable. 20.3 Any claim, complaint, or dispute initiated by the Applicant in connection with these Premium Terms, the Premium Services, billing, renewals, payment reversals, or any related issue must first be raised directly with the Company in good faith through the designated support channel. 20.4 Where formal proceedings are initiated by the Applicant and to the extent permitted by applicable law, such proceedings shall be submitted and administered through the World Intellectual Property Organization (“WIPO”) in accordance with its applicable rules, procedures, and guidelines then in force, if and insofar as that mechanism is relied upon under the Company’s governing dispute framework. 20.5 The Applicant agrees that all costs associated with any such claim or proceeding, including filing fees, administrative charges, procedural expenses, legal costs, and related costs, shall be borne solely by the Applicant on a pre-paid and post-paid basis, to the fullest extent permitted by applicable law. 20.6 If any such claim is determined, in whole or in part, to be invalid, inadmissible, unfounded, abusive, or unsubstantiated, the Applicant shall remain fully liable, to the extent permitted by law, for all associated costs, including the Applicant’s own legal costs, all fees payable to WIPO, and all reasonable legal, administrative, and related costs incurred by the Company, in addition to any other fixed administrative or dispute-related fees lawfully due. 21. ENTIRE AGREEMENT; ASSIGNMENT; SEVERABILITY; NO WAIVER 21.1 Entire Agreement These Premium Terms, together with all documents incorporated by reference, constitute the entire agreement between the Applicant and the Company with respect to the Premium Services and supersede all prior discussions, statements, representations, or understandings on that subject. 21.2 Assignment The Company may assign, transfer, novate, delegate, subcontract, or otherwise dispose of its rights or obligations under these Premium Terms without the Applicant’s consent. The Applicant may not assign or transfer any rights or obligations under these Premium Terms without the Company’s prior written consent. 21.3 Severability If any provision of these Premium Terms is found invalid, unlawful, or unenforceable, that provision shall be interpreted, modified, or severed only to the minimum extent necessary, and the remainder of the Premium Terms shall remain in full force and effect. 21.4 No Waiver No failure or delay by the Company in enforcing any provision or right shall constitute a waiver of that provision or right. 21.5 Survival All provisions which by their nature are intended to survive termination or expiry shall survive, including provisions relating to payment, non-refundability, Subscription renewals already incurred, dispute costs, Chargebacks, disclaimers, liability limits, indemnities, governing law, and dispute resolution. 22. EXPRESS CONFIRMATION BY PROCEEDING By proceeding with any Enhanced Screening Service or Premium Service, the Applicant expressly confirms and agrees that: (a) the Applicant has carefully read and understood these Premium Terms in full; (b) the Applicant understands that all payments are generally final and non-refundable except where mandatory law requires otherwise; (c) the Applicant understands that Premium Services may include recurring billing and automatic renewal unless properly cancelled; (d) the Applicant accepts full responsibility for all information and documentation submitted; (e) the Applicant understands that the Company does not control Provider outcomes and does not guarantee acceptance of any Screening Report; and (f) the Applicant agrees to be legally bound by all provisions contained in this legally binding document.

1. Introduction and Scope of This Privacy Policy

This Privacy Policy (“Privacy Policy”) governs the collection, use, processing, storage, disclosure, retention, and protection of personal data by Capita Screening, acting as the data controller and, where applicable, as a data processor, in connection with the provision of its digital identity, financial, compliance, verification, screening, reporting, and optional premium services (collectively, the “Services”). This Privacy Policy applies to all Applicants, users, visitors, and account holders (“Applicant”) who access or use the Capita Screening websites, platforms, applications, interfaces, screening tools, reports, or related services, regardless of whether such use is free, trial-based, paid, premium, direct, indirect, mandatory, optional, or provider-requested.

This Privacy Policy is designed to reflect a Privacy by Design and Privacy by Default framework and is drafted to comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), as well as any applicable national implementing legislation, regulatory guidance, and supervisory authority interpretations. Where local laws impose additional or stricter obligations, those obligations shall apply concurrently. This Privacy Policy must be read in conjunction with any service-specific notices, screening disclosures, or supplemental privacy statements issued by Capita Screening, all of which form an integral part of the privacy framework governing the Services.

2. Legal Basis, Regulatory Framework, and Compliance Architecture

Capita Screening processes personal data strictly in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity, confidentiality, and accountability. Where special categories of personal data may be processed as part of enhanced screening, compliance, or verification workflows, such processing shall only occur where strictly necessary, proportionate, and permitted by law, and shall be subject to heightened technical and organizational safeguards. Capita Screening reserves the right to adapt its compliance framework dynamically to reflect evolving regulatory interpretations, supervisory authority guidance, case law, or statutory amendments, without diminishing the level of protection afforded to Applicants.

3. Categories of Personal Data Collected and Sources of Data

• Identification and account-related data, including account identifiers, authentication credentials, verification tokens, and communication preferences
• Contact data, such as email addresses or phone numbers, where voluntarily provided or required for verification, security, or compliance purposes
• Financial and banking data strictly limited to verification and validation purposes, including bank account identifiers used for micro-transaction validation (e.g., one cent verification)
• Screening-related data submitted directly by the Applicant, including uploaded documents, declarations, confirmations, selections, and responses
• Technical and security-related data, such as device metadata, anonymized analytics, temporary IP data, and authentication logs, where applicable
• Payment and subscription-related metadata processed via third-party payment service providers

All personal data is obtained either directly from the Applicant, generated through interaction with the Services, or received from lawful third-party verification sources strictly within the scope of the screening request.

4. Website Visits, Analytics, and Technical Operation

When visiting Capita Screening-operated websites or interfaces, Capita Screening may collect limited technical data necessary to ensure functionality, security, and performance. Analytics are implemented through self-developed or locally hosted tools designed to avoid unnecessary tracking, profiling, or identification. Wherever feasible, data is anonymized or aggregated at the earliest possible stage, and IP addresses are not retained beyond what is strictly necessary for security, abuse prevention, or regulatory compliance.

Capita Screening does not engage in behavioral advertising, cross-platform tracking, or unauthorized third-party analytics sharing. Any cookies or similar technologies used are limited to essential operational purposes unless otherwise explicitly consented to by the Applicant.

5. Account Creation, Authentication, and Verification Measures

Applicants may create an account using either a Capita Screening-issued identifier or an external email address. The creation of an account does not, in itself, require the disclosure of extensive personal data beyond what is necessary to establish account integrity, security, and lawful operation. External contact details, if provided, are used exclusively for authentication, recovery, security notifications, service-related communications, and legally permissible informational messages.

To protect the Services from abuse, fraud, automated attacks, or unauthorized access, Capita Screening employs human verification mechanisms, including captchas, email verification, SMS codes, and similar safeguards. Any data processed for such verification purposes is retained only for the minimum period necessary and, where retained longer, is stored in hashed or otherwise cryptographically protected form.

6. Screening Data, Bank Account Verification, and Reporting

As part of the screening process, Applicants may be required to submit financial, identity, or verification-related data. Bank account verification may involve a nominal micro-payment (e.g., one cent) solely for the purpose of confirming account ownership and validity. Such financial identifiers are processed within secured database environments employing encryption, access controls, and audit mechanisms consistent with industry best practices.

Screening reports generated by Capita Screening are based exclusively on data provided by the Applicant, third-party verification responses, and predefined processing rules. Capita Screening does not guarantee outcomes, acceptance, approval, or suitability determinations, as these remain subject to provider-specific criteria and external decision-making processes beyond Capita Screening’s control.

7. Communications and Correspondence

Communications between the Applicant and Capita Screening, including support inquiries, document requests, workflow updates, and service notifications, may be stored for quality assurance, dispute resolution, legal defense, compliance verification, and operational continuity. By using the Services, the Applicant consents to receive electronic communications related to account status, screening progress, required actions, payment confirmations, and security notifications. Such communications are deemed legally effective and equivalent to written notices.

8. Premium Services, Subscriptions, and Payment Processing

Where Applicants elect to subscribe to optional Premium Services, Capita Screening may process additional interaction data necessary to evidence informed consent, subscription acknowledgment, and awareness of non-refundable terms. Payment processing is conducted exclusively through third-party payment service providers, and Capita Screening does not store full payment instrument details. Only transaction metadata strictly necessary for reconciliation, compliance, and audit purposes may be retained.

Capita Screening reserves the right to delete obsolete or invalid payment-related data in accordance with data minimization principles and applicable financial record-keeping obligations.

9. Recording of User Selections, Consent Evidence, and Transactional Acknowledgments

By registering for, accessing, or participating in the Screening Process through Capita Screening’s mobile, web-based, or otherwise made available digital environments, the Applicant expressly acknowledges and agrees that Capita Screening processes and securely records technical, transactional, and interaction-based data evidencing the Applicant’s selections, confirmations, and affirmative actions throughout the screening registration and screening workflow.

Such processing includes, without limitation, the recording of which service options, screening pathways, and service tiers (including any optional Premium Services) have been selected by the Applicant, as well as the Applicant’s explicit acceptance of the applicable Privacy Policy, Terms and Conditions, Premium Terms of Service, and any related notices or disclosures presented at the time of selection. These acceptance records are stored in secured database environments using appropriate technical and organizational safeguards and are retained for the purposes of compliance verification, auditability, fraud prevention, dispute resolution, and legal defense.

The Applicant expressly acknowledges that the recorded selections, acceptances, and confirmations constitute conclusive evidence of the Applicant’s informed and voluntary decisions and agrees that the Applicant bears sole responsibility for all choices made, options selected, and authorizations granted during the screening and registration process. This includes, without limitation, acknowledgments relating to the activation of Premium Services, authorization of payments or recurring charges, and the acknowledgment of the non-refundability and irrevocability of transactions.

The processing and retention of such data is carried out on the basis of the Applicant’s consent, the necessity to perform requested services, and Capita Screening’s legitimate interests in maintaining service integrity, ensuring legal compliance, preventing fraud, and defending against claims, disputes, or regulatory inquiries.

By accepting this Privacy Policy, you expressly acknowledge, confirm, and agree that such acceptance applies to and includes all sections, clauses, and sub-clauses of this Privacy Policy, each of which shall be binding upon you.

9.1. Voluntary Selection of Premium Services and Consent-Based Processing

Certain enhanced or Premium Services offered by Capita Screening are optional, non-standard, and provided only where expressly selected by the Applicant. The activation of any Premium Service requires a deliberate, affirmative action by the Applicant and is never enabled automatically, implicitly, or by default. Where an Applicant elects to activate such Premium Services, Capita Screening processes personal data relating to that selection on the basis of explicit consent, performance of a requested service, and legitimate interests, including compliance verification, fraud prevention, billing integrity, and legal accountability.

By selecting a Premium Service, the Applicant acknowledges that the decision is voluntary, informed, intentional, and taken with full awareness of the applicable pricing model, recurring nature (if applicable), non-refundability of payments, and the corresponding data processing activities required to administer, evidence, and defend that selection. Capita Screening processes and retains confirmation records solely to demonstrate lawful consent, user intent, and transactional validity.

9.2. Processing of Subscription Data, Recurring Billing, and Payment Authorization Records

Where Premium Services are structured as subscriptions, Capita Screening processes subscription-related personal data necessary to administer recurring access, billing cycles, renewal events, and cancellation status. Subscriptions renew automatically at the conclusion of each billing period unless the Applicant actively terminates the subscription using the designated cancellation mechanism. Processing of subscription data is based on contractual necessity and legitimate interests in maintaining service continuity, payment accuracy, and auditability.

By initiating a subscription, the Applicant expressly authorizes Capita Screening and its designated payment service providers to process payment-related data and to charge the selected payment method for all applicable fees, taxes, transaction costs, and ancillary charges in accordance with the chosen plan. Capita Screening does not determine or control payment authorization outcomes and is not responsible for charges incurred due to the Applicant’s failure to maintain valid payment credentials or to cancel in a timely manner.

9.3. Trial Periods, Verification Charges, and Conversion Event Processing

Where Capita Screening offers a trial period or nominal verification charge (including but not limited to a one-cent authorization), personal data relating to such trials is processed exclusively for service evaluation, payment method validation, fraud prevention, and compliance documentation. Trial-related processing may include authorization holds, temporary charges, or verification transactions performed by payment service providers, which may affect available balances or credit limits.

The Applicant acknowledges that any trial period, where offered, automatically converts into a paid Premium Service unless cancelled prior to expiration. Data relating to trial commencement, expiration, conversion, and billing initiation is processed and retained as evidence of user awareness, consent, and lawful transaction execution. Verification and authorization charges are non-refundable by nature and do not constitute refundable payments.

9.4. Cancellation Requests and Data Processing Consequences

Applicants may terminate an active Premium Service only through the designated cancellation mechanism identified as “Stop Premium Service.” Upon receipt and processing of such a request, Capita Screening records the termination event and ceases future renewals. However, cancellation does not affect the lawfulness of prior processing, nor does it generate any entitlement to refund, reimbursement, credit, or reversal of previously processed payments.

All personal data relating to charges incurred prior to the effective termination timestamp may be retained to the extent necessary for accounting, dispute defense, regulatory compliance, and legal enforcement. Cancellation affects future access only and has no retroactive financial or data-processing effect.

9.5. Irrevocability of Payments and Exclusion of Refund-Related Processing

All payments processed in connection with Premium Services are final, non-refundable, non-creditable, and non-reversible. To the maximum extent permitted by applicable law, Capita Screening does not process, support, or facilitate refunds, partial refunds, credits, paybacks, or payment reversals under any circumstances, including dissatisfaction, non-use, partial use, mistaken activation, early termination, failure to cancel, third-party decisions, or perceived lack of suitability.

By proceeding with payment, the Applicant explicitly acknowledges and accepts that payment-related personal data will not be processed for refund evaluation or reversal purposes. The Applicant further acknowledges that any attempt to initiate a chargeback or payment dispute through external financial institutions constitutes a deviation from the agreed processing framework and may trigger additional data processing for enforcement, defense, and fraud prevention.

9.6. Chargeback Events, Fraud Detection, and Defensive Data Processing

In the event that an Applicant initiates or attempts to initiate a chargeback, reversal, or unauthorized payment dispute, Capita Screening may process and retain relevant personal data under its legitimate interests in fraud prevention, financial risk mitigation, and legal defense. Such processing may include the retention and disclosure of transaction records, interaction logs, timestamps, confirmations, and other evidentiary materials to payment processors, financial institutions, dispute resolution bodies, or competent authorities, strictly to the extent necessary.

Chargeback-related events are classified as high-risk financial incidents. Accordingly, Capita Screening reserves the right to restrict, suspend, or terminate account access and to retain associated personal data for the duration required to resolve disputes, recover costs, and comply with regulatory obligations.

9.7. Retention of Consent Evidence and Transactional Proof

For accountability purposes under data protection law, Capita Screening may retain records demonstrating the Applicant’s affirmative actions, consent acknowledgments, subscription selections, pricing disclosures, non-refund awareness confirmations, button interactions, timestamps, and related technical metadata, including IP-derived information where lawfully permitted. Such retention is limited to what is necessary to demonstrate compliance with legal obligations, defend against disputes or claims, and prevent fraudulent or abusive conduct.

This processing is strictly purpose-bound and does not constitute profiling, excessive retention, or unrelated secondary use.

10. No Waiver, No Precedent, and Reservation of Data Protection and Legal Rights

Any tolerance, exception, or discretionary action exercised by Capita Screening in an individual case shall not constitute a waiver of this Privacy Policy, shall not create precedent, and shall not give rise to future expectations or obligations. Capita Screening reserves all rights to process personal data as permitted by law for enforcement, compliance, dispute resolution, and protection of its legal and financial interests, in conjunction with other applicable policies and contractual frameworks.

11. Data Retention and Storage Limitation

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected, including screening completion, reporting, compliance, dispute resolution, legal defense, and statutory obligations. Retention periods may vary depending on the nature of the data, contractual relationships, regulatory requirements, and legitimate interests. Upon expiration of applicable retention periods, data is securely deleted, anonymized, or rendered inaccessible.

12. Data Disclosure and Legal Requests

Capita Screening discloses personal data only where legally required by binding requests from competent authorities within applicable jurisdictions. All such requests are carefully reviewed for legal validity, proportionality, and jurisdictional competence. Where permissible, Capita Screening reserves the right to challenge or seek clarification of requests and to exhaust available legal remedies prior to disclosure. Under no circumstances does Capita Screening decrypt encrypted content or provide access beyond what is legally mandated.

13. Applicant Rights

Applicants have the right to access, rectify, erase, restrict, object to, or request portability of their personal data, subject to legal limitations. These rights may be exercised through account interfaces or by contacting Capita Screening. Where an account has been suspended or restricted, requests will be handled in accordance with applicable law. Applicants also retain the right to lodge a complaint with a competent supervisory authority.

14. Security, Risk Allocation, and Limitation of Liability

Capita Screening implements technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, or alteration. However, no system can be guaranteed to be fully secure. The Applicant acknowledges that data submission occurs at the Applicant’s own risk and that Capita Screening shall not be liable for damages resulting from circumstances beyond its reasonable control, including sophisticated cyberattacks, third-party failures, or force majeure events.

15. Amendments to This Privacy Policy

Capita Screening reserves the right to amend this Privacy Policy at any time within the limits of applicable law. Updated versions will be made available through the Services. Continued use of the Services following publication of changes constitutes acknowledgment and acceptance of the revised Privacy Policy.
